1. Meanings


1.1 Meanings

‘Applicable Law’ means in relation to any person, action or thing means the following in relation to that person, action or thing:

(a) any law, rule or regulation of any country (or political sub-division of a country);

(b) any obligation under any licence in any country (or political sub-division of a country); and

(c) any lawful and binding determination, decision or direction of a regulator in any country (or political sub-division of a country).

‘Booking Terms’ means the terms contained below.

‘Content’ means anything that you may see, read, hear, download or access on or via the Site (including but not limited to messages, files, data, software, images, artwork, design, photographs, illustrations, text, music, songs and other materials or subject-matter on the Site).

‘Site’ means www.territorydiscoveries.com.

‘Terms and Conditions’ means the term and conditions contained on this Site and those revised in accordance with clause 1.4 of the Terms of Use appearing in the Site.

‘Territory Discoveries’ means Territory Discoveries (a Government Business Division of Tourism NT) our employees, agents and where the context permits third party providers and distributors.

‘we’, ‘our’ or ‘us’ means Territory Discoveries.


2. Booking and Purchase Terms


2.1 Agents

Unless we expressly state otherwise, we act as agents for third party providers and distributors for all products and services purchased by you on the Site.


2.2 Site Information

Whilst we focus on providing accurate information, details of products, prices and events described in the Site these may change and you are advised to check all details with your Territory Discoveries holiday consultant. Products and services on this website are valid from 1st April to 31st March each year, unless otherwise stated and are subject to change.


2.3 Prices

Prices contained in the Site are:

(a) valid from 1st April until 31st March in each year;

(b) in Australian Dollars (AU$); and

(c) inclusive of GST; and

(d) subject to change.


2.4 Credit Card Fees

Payments can be made with credit cards subject to the following surcharges on the total booking price:

(a) Bankcard, Mastercard and Visa: 1.4%

(b) American Express 3.3%

(c) Diners Club 2.56%


2.5 Booking and Purchasing On-Line or with Help

You can make bookings for or purchase products and services:

(a) completely online at the Site by your online acceptance and payment on the terms and conditions of the Site; or

(b) by sending a quote enquiry to one of our holiday consultants who will contact you to enable you thereafter to make a booking or enter a contract to purchase products and services; or

(c) by enlisting a licensed travel agent and asking them to make a booking or purchase the relevant products and services for you.


2.6 Enforceable Contract

You hereby agree:

(a) to waive any rights to challenge the validity or enforceability of any contract entered into on the Site on the grounds that it was made in electronic form and not by paper and/or signed or sealed; and

(b) that by indicating your acceptance to purchase any product or service offered on the Site, you are obligated to complete such transactions; and

(c) you are prohibited from indicating your acceptance to purchase products and services where you do not intend to complete such transactions; and

(d) by submitting an order to purchase goods or services, you represent and warrant that you have the legal right to purchase, utilise and/or possess such goods or services.


2.7 Third Party Terms

You will be bound by terms and conditions imposed by the third party providers and distributors referred to on the Site for whom the we act as an agent including conditions of carriage, refund and cancellation policies of airlines, car hire operators, hotels, tours etc.


2.8 Other Necessary Arrangements

You understand that all products and services purchased require other things to be completed and documented before they may be used (‘Remaining Matters’), such as issuance of air tickets and travel vouchers. Remaining Matters are performed during normal office hours. As such, any travel requests and bookings made require a minimum processing time of varying periods, subject to the specific terms and conditions applicable to the type of product or service purchased.


2.9 Unavailable Products and Services

We will not be held liable for any claims for loss, damages or compensation against unavailability or unacceptable availability of a product or service:

(a) acquired by you that cannot be delivered or provided between the time of booking and the time of departure. (In such an event, we will refund to you all unutilised monies collected from you for that purchase excepting the booking fee); or

(b) purchased on your behalf by us from third party providers and distributors, such as, but not limited to, airlines, hotels, tour operators, car hire companies, insurance companies, and other entities (including but not limited to overbooking passengers on their flights or re-schedule flight times).


2.10 Booking and Purchase Terms

You acknowledge that all prices are subject to change until full payment is received and are subject to third party providers and distributors availability and that:

(a) a booking fee may be payable on some bookings;

(b) for each booking less than $150 in value, a charge of $20 per booking will be incurred;

(c) if you wish to alter your flight travel once tickets have been issued a charge of $30 per person per reissue will be incurred in addition to the third party provider airfare fees;

(d) if you wish to alter your arrangements after your original booking, we will try to assist. However, once a deposit has been received, a charge of $30 per amendment will be incurred in addition to any costs charged by the third party provider;

(e) child accommodation prices displayed on the Site are based on children sharing with two adults and utilising existing beds in rooms or apartments. Additional charges may be incurred if extra beds are required;

(f) all available tour prices listed on the Site are per adult based on twin share accommodation where applicable (unless expressly stated);

(g) additional charges will be incurred if single occupancy of accommodation is required;

(h) some airport taxes are not pre-payable or pre-paid and you must pay these when required;

(i) some airlines or travel service providers have introduced fuel surcharges which may not be reflected in the prices shown and will be an additional charge;

(j) for travel services such as air tickets, hotels, cars or packages availability, prices, fare conditions and class of travel can change at any time without notice;

(k) routing restrictions and other special conditions may apply;

(l) certain countries require that foreign nationals entering hold a passport with at least six (6) months validity remaining. This information as well as other related information supplied by us within the Site are supplied in good faith; and should be treated as a guide only;

(m) passport, visa (including transit visa/s) and health requirements are the responsibility of all individual travellers. The sole responsibility for ensuring travel documentation is correct is your responsibility;

(n) we reserve the right to decline any booking or purchase for any reason and shall not be held liable for any resulting claims for loss, damages or compensation. In such an event, we shall refund to you all unutilized monies collected from you for that purchase;

(o) you agree to bear the full cost of any booking, cancellation and administration fees for any products or services booked but not utilized for any reason. In some cases, we may charge cancellation and/or amendment fees in addition to those imposed by third party providers and distributors; and

(p) you agree that multiple over-lapping bookings for the same traveller or travellers are not allowed and may result in damage and loss to us, which you will bear in full.


2.11 Insurance

Territory Discoveries and our third party providers and distributors do not include any insurance cover in connection with our products and services. We strongly recommend travel insurance, which can cover many potential losses including, loss of deposit and cancellation fees, loss of monies or baggage. Ask a Territory Discoveries holiday consultant for a range of policies to suit your needs.


2.12 Cancellations of Bookings and Purchases

Terms and conditions for cancellation of bookings and purchases will vary for each third party providers and distributors and will be governed by the terms and conditions of the specific product or service provider you acknowledge:

(a) the refund timeline will vary;

(b) cancellation, at your request, may not be allowed or may require a minimum processing time of varying periods, subject to the specific terms and conditions applicable to the type of product or service purchased; and

(c) cancellation may be subject to cancellation fees which you agree to bear in full. We suggest you check these matters with our team by calling a Territory Discoveries Sales Consultant during operating hours.
